Terms of Service
These terms govern your use of fbasupport.com and the website design, hosting and support services Franchise Brokers Association, Inc. (“FBA”, “we”, “us”) provides to FBA members (the “Services”). By using the site or the Services, you agree to these terms.

Who can use the Services
The Services are available to active FBA members. We confirm membership using the email on your FBA account and may decline or pause a request we cannot verify.
If your FBA membership ends, hosting of your site on the FBA network ends with it. Before we take the site down, we will email you a .zip file of your site’s content and media so you can move it to another host.
What is included
Complimentary services for active members include:
- A standard website built from one of our templates, with two rounds of revisions and a delivery meeting.
- Hosting on the FBA network.
- Standard support: fixes, bugs and content updates.
- Minor refreshes: copy, color and image changes.
We decide what counts as standard, and we tell you before starting any work that falls outside it.
Custom work and billing
Custom website builds, new pages, structural changes, custom features and tools, and work beyond the scope agreed in your designer call are billed at $150 per hour.
- We send a written proposal with scope, estimate and timeline. No billable work starts until you approve it.
- Changes to an approved scope may need a revised proposal.
- Invoices are due on receipt. We may pause custom work while an invoice is unpaid.
- Fees for work already completed are not refundable.
The hourly rate may change. Any change applies only to proposals issued after it takes effect.
Timelines and response times
A standard site typically launches in 2 to 4 weeks. The timeline starts once we have your request, all of your assets and delegate access to your domain. We aim to reply to every request within 24 business hours.
These are good-faith estimates, not guarantees. Delays in receiving content, approvals or access move the timeline.
Your responsibilities
- Give us accurate information and use the email on your FBA account.
- Send only content you own or have permission to use, including logos, photos, testimonials and trademarks.
- Review your site before launch and after each revision round.
- Keep your own copies of important content.
- Keep your domain registration, renewals and any third-party accounts in good standing.
You grant FBA a license to use, copy, edit and display your content as needed to build, host and support your site.
Franchise marketing compliance
You are responsible for everything published on your site, including compliance with the FTC Franchise Rule, state franchise and advertising laws, and FBA’s own standards. In particular, your site must not include earnings or performance claims unless they are permitted and supported by the relevant franchisor’s disclosure documents.
We may flag or decline content we believe creates a compliance risk, but we do not provide legal review. Please consult your own advisor.
Domains and third-party accounts
You buy and own your domain. You grant us delegate access at your registrar so we can connect and manage DNS settings for your site, and you may remove that access at any time, which may stop your site from working. Registrar fees, email services such as Google Workspace, and other third-party subscriptions are your responsibility and are governed by those providers’ terms.
Ownership
You own your content and, after the delivery meeting, the website built for you, including its WordPress login.
FBA and its licensors keep all rights in our templates, themes, plugins, code, design system and the fbasupport.com site. You may use them as part of your site while it is hosted on the FBA network. If you move your site off the network, you take your site’s content and media with you. Our templates, themes, plugins and code stay on the network.
Unless you ask us not to, we may show your site, business name and screenshots on fbasupport.com, including our Our work page and member site directory.
Hosting on the FBA network
- We manage the shared platform, including themes, plugins, updates, security and backups. Please do not install plugins, change themes or edit shared code without our approval.
- We may make changes to the platform to keep it secure and working, and we schedule maintenance to limit disruption.
- We aim for reliable hosting but do not guarantee that any site will always be available or work without errors.
- We may suspend a site that is compromised, puts the network at risk, or breaks these terms, and we will tell you why.
Acceptable use
You may not use the Services or your site to:
- Break any law or infringe anyone’s rights.
- Publish false, misleading or deceptive content.
- Send spam or collect personal information without proper notice and consent.
- Upload malware or try to access other members’ sites, accounts or data.
- Interfere with the security or performance of the FBA network.
Third-party services
The Services rely on third-party tools such as HubSpot, Google, Pagely and domain registrars. We are not responsible for their availability, changes or terms. Guides on our Resources page link to third-party instructions that may change without notice.
No guarantee of results
The site and the Services are provided “as is” and “as available”. We do not guarantee any specific result, including search rankings, traffic, leads or sales. Content on fbasupport.com, including guides and downloads, is general information, not legal, financial or tax advice.
Limitation of liability
To the fullest extent the law allows, FBA is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from the site or the Services. Our total liability for any claim is limited to the amount you paid us for the Services in the twelve months before the claim.
Indemnification
You agree to defend and indemnify FBA and its officers, employees and contractors against claims arising from your content, your site, your use of the Services or your breach of these terms.
Suspension and termination
You may stop using the Services at any time. We may suspend or end the Services if your membership ends, if you break these terms, or if we are required to by law. Sections that by their nature should survive, such as ownership, payment, disclaimers, liability and indemnification, continue after termination.
Governing law
These terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Florida, and you consent to their jurisdiction.
Changes to these terms
We may update these terms from time to time. We will post the new version here and change the date at the top. Continuing to use the site or the Services after an update means you accept it.
